Welcome to Newlin Painting (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website at https://www.newlinpainting.com (the “Site”) and any related services. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Use of the Site

The Site is provided for informational purposes about Newlin Painting's painting services. You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:

2. Estimates & Pricing

All estimates provided through the Site, by phone, or in person are non-binding and subject to on-site verification of project conditions. Final pricing will be provided in a written estimate or proposal after an in-person assessment. Prices may vary based on:

  • Actual surface conditions discovered during prep work
  • Changes in project scope requested by the client
  • Material cost fluctuations
  • Additional repairs or prep work required beyond the original scope

Any changes to the agreed-upon scope and price will be discussed with you and approved in writing before additional work is performed.

3. Service Agreements

Painting services are governed by a separate written estimate, proposal, or contract between you and Newlin Painting. In the event of any conflict between these Terms and a signed service agreement, the service agreement shall prevail.

4. Scheduling & Access

By engaging our services, you agree to provide reasonable access to the property for the duration of the project. You are responsible for:

  • Ensuring the work area is accessible on scheduled dates
  • Moving personal items, furniture, and valuables away from work areas (unless otherwise arranged)
  • Informing us of any known hazards, lead paint, asbestos, or structural concerns
  • Securing pets during active work hours

We reserve the right to reschedule work due to inclement weather, safety concerns, or circumstances beyond our control. We will communicate any schedule changes as soon as possible.

5. Payment Terms

Payment terms are outlined in your project estimate or proposal. Unless otherwise stated in writing:

  • A deposit may be required before work begins
  • Final payment is due upon completion and your satisfaction with the work
  • We accept cash, check, and major credit cards
  • Balances remaining unpaid for more than 30 days may be subject to a late fee

6. Warranty & Workmanship

Newlin Painting stands behind our work. We provide a workmanship warranty on all painting projects as specified in your written estimate or proposal. This warranty covers:

  • Peeling, blistering, or flaking caused by improper application
  • Color inconsistencies resulting from our work

The warranty does not cover:

  • Normal wear and tear
  • Damage caused by the homeowner, tenants, or third parties
  • Damage from severe weather events, flooding, or acts of nature
  • Pre-existing conditions disclosed before the project
  • Color fading due to UV exposure over time (a natural process)

7. Liability Limitations

Newlin Painting is fully licensed and insured in the Commonwealth of Virginia. We carry general liability insurance and workers' compensation coverage for all crew members. However:

  • Our total liability for any claim arising from our services shall not exceed the total amount paid for the specific project in question.
  • We are not liable for indirect, incidental, special, or consequential damages arising from our services or your use of the Site.
  • We are not responsible for pre-existing structural damage, hidden defects, or conditions that could not have been reasonably identified during our assessment.

8. Intellectual Property

All content on the Site — including text, images, logos, graphics, and design elements — is the property of Newlin Painting LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any Site content for commercial purposes without our written consent.

Photos of completed projects may be used by Newlin Painting for marketing purposes (website, social media, advertising) unless you specifically request otherwise in writing.

9. User-Submitted Content

By submitting information through our contact forms, you grant Newlin Painting the right to use the information to respond to your inquiry and provide services. You represent that any information you provide is accurate and that you have the authority to share it.

10. Third-Party Links

The Site may contain links to third-party websites or services (e.g., social media pages, review platforms, material suppliers). These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party site.

11. Indemnification
